  • ChinaOnYourMind.com is not responsible for the exchange or refund for any lost, stolen, or destroyed documents. Unforeseeable circumstances such as force majeure, adverse weather conditions, airline flight rescheduling, hotel overbooking, technical faults with transportation and road conditions may also have a consequential effect on the content and schedule of the tour after commencement. However, we will take all benefits and all losses of any fluctuations, lower or higher in airfares, cruise fares, currency devaluation, park fee increases, taxes, or fuel surcharges after we have received the full payment.
  • Any decision made in respect of tour services provided by independent operators to reroute or amend the itinerary due to any of the above, or similar, circumstances is at the discretion of the tour service provider. ChinaOnYourMind.com shall not be liable for any claim whatsoever arising from such events, which affect the schedule and the content of the tour.

Terms & Conditions

These Terms & Conditions and all information contained on this web site form the basis of the contractual relationship between ChinaOnYourMind.com and all its clients. It is extremely important that you, the client, accept and understand the Terms & Conditions as well as all web-site contents before you make your booking. By making a booking with us, you will have agreed to accept our Terms & Conditions.

RESERVATION

All reservations are subject to availability at the time of booking. Reservations will only be confirmed after ChinaOnYourMind.com receives written confirmation of your booking from the hotel, airline or tour operator.

Air

No new bookings or revisions may be made inside of 7 days prior to departure.

Hotel

Changes to a reservation within 72 hours can be made for a $25.00 fee. Changes to a reservation outside of 72 hours are subject to the difference in the hotels' nightly rate. Items not included in the rates include but are not limited to: baggage handling, tips and gratuities, meals, roll away beds, and cribs. These items are the sole responsibility of the passenger and should be paid directly when the services are rendered.

Tour

Within 15 days prior to departure, any amendment to confirmed travel arrangements will incur a fee of $50.00 per change, in addition to any charges levied by ground operators, airlines, hotels, or other service providers. An amendment constitutes a change to an existing booking and does not include transfer to another tour. In the case of a transfer to another tour, the applicable cancellation fees will apply. Reservations made within 14-8 days prior to departure will incur a non-refundable Late Booking Fee of $25.00 per file. Full payment for the package together with the Late Booking Fee must be received by ChinaOnYourMind.com within 48 hours of the booking request. No reservation will be processed until ChinaOnYourMind.com receives the applicable payment. Failure to comply with these terms of payment will result in the automatic cancellation of the reservation request. In the event that the reservation cannot be confirmed, the Late Booking Fee of $25.00 will be retained by ChinaOnYourMind.com but the balance of money will be refunded. No reservations will be accepted within 7 days prior to departure.

PRICES

Prices are based on tariffs and rates of current exchange and are quoted in US dollars.In the event of fluctuations in currency exchange rates, service providers' tariffs, fuel prices, accommodation rates and other tour service components, ChinaOnYourMind.com reserves the right to adjust prices at any time up to and including the date of departure, even after receipt of the full payment from the client. Acceptance of this arrangement is an express condition of making a reservation. You will be notified of any alteration to advertised prices via e-mail, provided we have the correct e-mail address.

PAYMENT

Tour

All transactions will be conducted in United States currency.Payment should be made by wire transfer, which is the safest way. The transfer charge is on your own. Please note that it will take about 5 to 10 days for your money to reach our account. Our bank account number will be mentioned via email to your indicated email address. By sending the deposit, you agree to be bound by our Terms and Conditions.

  1. A non-refundable of $200 per person is required at the time of booking. The deposit will be deducted to your  final payment.
  2. Final balance of the payment is due 30 days prior to tour departure date.
  3. If a booking is made within 30 days before tour departure date, full payment must be settled upon confirmation.
  4. Should the total payment not be received by due date, any reservations already made in respect of the tours will be automatically cancelled.
  5. After you have made the wire transfer in your bank, please make a copy of the transaction receipt by the bank, write down your tracking code and tour code on the copy and fax us the copy of the transaction receipt (Fax no. 86-10-65046501). Once we have received your payment fax, we will start to secure your booking.

Air & Hotel

Once reservations are confirmed, payments must be made 14 days prior to departure dates. No late payments will be accepted by ChinaOnYourMind.com.

CANCELLATION OR REFUND

Air

Once tickets are issued, a fee equal to 25% of the ticket price plus tax will be charged if the tickets are cancelled within 48 hours prior to original departure time.

Hotel Reservations

There is no fee for cancellations or changes made outside of 72 hours (3 days) prior to arrival. Cancellations made within 72 hours (3 days) are subject to a fee equal to the first night plus tax.

Tours

Refunds or allowances will not be made for transportation, accommodations, tickets, services, or other portions of the tour which are unused on or after the tour departure date.

The following cancellation fees or refunds shall apply if, for any reason, the client cancels a tour. All cancellation terms are specified on a per person basis.

The cancellation fees are calculated according to the days of notice received prior to scheduled date of entering China. The penalty will be a percentage on the tour price:

30-17 days prior to the scheduled tour is 15%;
16-10 days prior to the scheduled tour is 35%;
9-3 days prior to the scheduled tour is 55%;
2-1 days prior to the scheduled tour is 85%;
On or after departure date is 100%.
For Yangtze River tour with the tourist boat, special provisions will be adopted:

31 days prior to the scheduled tour is 25%;
30-16 days prior to the scheduled tour is 55%;
Less than 16 days prior to the scheduled tour is 100%;
Such policy is imposed upon us by the tourist boat company.

OPERATION DETAILS

Tour Operation

Although ChinaOnYourMind.com will endeavor to ensure that tours are available as advertised, an express condition of making a reservation is the acceptance by the client that tour itineraries and schedules, advertised accommodation, sightseeing programs and modes of transportation as outlined on this web site and/or supplied in pre-departure information are subject to change without prior notice. Air travel, coach journeys and other forms of transport and hotel accommodation are provided by independent operators and all bookings through ChinaOnYourMind.com are subject to the terms, conditions and limitations of carriers, hotels and other service providers.

If your booking needs to be altered due to circumstances beyond our control, we reserve the right to vary your itinerary and inform you of the subsequent changes. If the varied itinerary is only available at a higher cost, the client will bear the increased price. Should such changes result in an itinerary which is materially different from your requested program and we have accepted your payment, you reserve the right to withdraw from the tour program and all money received by ChinaOnYourMind.com will be refunded in full.

If for any reason, ChinaOnYourMind.com is forced to cancel a tour program, clients will be offered an alternative tour of a similar standard and arrangement. Should the alternative be unsuitable to the client, all money paid to ChinaOnYourMind.com in respect of the original tour program will be refunded in full.

An alternative itinerary or a refund of money offered or paid in the event of a tour change or cancellation is in full satisfaction of any claim for loss of enjoyment resulting from the change or cancellation

Group Departure

Quoted popular tour prices are based on a minimum number of 2-10 adults travelling together and staying in twin share accommodation as stated in each tour.

Quoted special tour prices are based on a minimum number of 10 adults travelling together and staying in twin share accommodation as stated in each tour.
Should the minimum number of persons not be attained, ChinaOnYourMind.com reserves the right to cancel, amend or reprice the tour program. If such an event occurs, we shall endeavor to provide the choice of an alternative tour or the client may continue the tour as amended or cancel participation of the tour altogether in which case a full refund of the tour cost will be made.

Single Travelers

Tour Packages: Single travelers who are willing to share accommodation with another tour member must advise ChinaOnYourMind.com at the time of reservation. ChinaOnYourMind.com will endeavour to match the client with a suitable person for the duration of the selected tour. If ChinaOnYourMind.com is unable to allocate a suitable person to share accommodation, the single supplement cost as specified is to be paid by the client at the time of balance payment. For clients who choose to have a sole occupancy of a room throughout the tour, the specified single supplement cost will be payable at the time of balance payment.

Plan Your Own Itinerary: Single occupancy of a room by choice or circumstance is subject to the applicable supplement cost and payable to ChinaOnYourMind.com

Items Included in Group Tour Costs (private tours are on a case-by-case basis)

Share twin-bedded hotel accommodations with ABFs (American Breakfast) included.
Admission fee in the listed sightseeing programs.
Air conditioned bus and English-speaking guides.
Domestic airfares and airport tax.
All breakfast. Lunches and dinners as specified in the programs.
All round trip transfers in the sightseeing programs.
Travel agency liability insurance.

Items Not Included in Your Tour Costs

The tour costs quoted exclude items not specifically referred to in the tour description including, but not limited to,

Pre-travel documentation.
Excess baggage charges, portage in China, gratuities.
Meals (unless specified).
International airfare and airport taxes and interstate/intrastate travel arrangements to and from home town and departure cit.
Items of a personal nature such as laundry, dry cleaning, beverages, personal accident and medical expenses,
incidental expenses, taxis where not part of a regular transfer, telephone and telecommunication charges.

Chinaonyourmind.com strongly recommends purchase of Insurance & Trip Protection.

PASSENGER RESPONSIBILITIES

Travel Documents

All clients must be in possession of a valid passport and necessary visas at the time of commencement of travel. All such documentation is the sole responsibility of the client. ChinaOnYourMind.com accepts no responsibility or liability whatsoever for the failure of clients to obtain appropriate documentation

Check in at airline gate or ticket counter at least one hour prior to scheduled departure with valid photo ID for each passenger. Due to heightened security at all airports, airlines are checking photo identification on all passengers. The name of each ticket must match a valid photo ID shown at the airport.

When a customer's ticket, or a portion of the ticket, is lost, stolen, or destroyed. He or she will be required to purchase a new ticket at the current fare. There will be no refund for a lost, stolen, or destroyed ticket.

Passengers may not make changes in their route, city of origin or destination, or exchange or transfer their tickets to another passenger or another airline.

Flight times are tentative and are subject to change without notice. It is suggested to confirm flight times 48 hours prior to departure.

Health Requirements

Clients should familiarize themselves with any health requirement applicable to areas they intend to visit. The client is solely responsible for compliance with vaccination and other health requirements of governments in countries visited or transited. The Department of Health or medical practitioners will be able to assist with current health requirements and recommendations.

Baggage

In accordance with the International Airline Regulations, the free baggage allowance for economy class passengers is 20kgs (44lbs) plus limited cabin luggage. Excess baggage charges are the sole responsibility of the client. Regulations within China specify that all suitcases must have a locking device attached. Failure to follow this regulation may result in refusal by airport staff to load suitcases onto the aircraft.

Complaints and Claims

Should the client feel that a valid complaint or claim should be lodged with ChinaOnYourMind.com or its service providers, the client hereby agrees to the following procedures and terms:

Should the client feel that a failure in performance of ChinaOnYourMind.com or its suppliers has occurred, the client agrees to immediately inform the local service provider. At this time, the local service provider will endeavor to promptly resolve the matter of complaint and inform ChinaOnYourMind.com of the specific circumstances. Should the local service provider be unable to assist or be unavailable, the client agrees to contact ChinaOnYourMind.com by email or telephone. In the event of a claim of compensation, the client agrees to inform ChinaOnYourMind.com in writing within 30 days of the date of tour completion. Relevant receipts and substantiating evidence, must be attached to the letter of claim.

ChinaOnYourMind.com will not be liable for any claims made later than 30 days after the date of tour completion.

CONSUMER PROTECTION

Details of important consumer Terms & Conditions and Operator Responsibilities relevant to all tour arrangements and information contained in this web site are outlined above. It is essential that these conditions and responsibilities are carefully read and understood prior to making a booking. Additionally, details or particular tours described in this site may have altered since. Changes in airfares, operators' tariffs and currency exchange rates may affect the price of particular tours. For these reasons, it is imperative that the client reconfirms all arrangements at the time of booking and prior to making payment.
